A freehold estate is an ownership interest in real property that lasts for an indefinite period, such as fee simple ownership or a life estate, as opposed to a leasehold estate, which lasts for a set term.

Freehold is the legal word for owning property outright, without an end date. If you own a building in fee simple, you hold a freehold estate. The contrast is a leasehold estate, where you have the right to use the property for a fixed term but the land belongs to someone else.

Types of Freehold Estates

  • Fee simple absolute: the most complete ownership: indefinite, transferable and inheritable.
  • Fee simple defeasible: ownership that can end if a stated condition occurs (for example, if the property stops being used for a certain purpose).
  • Life estate: ownership that lasts for a person's lifetime, after which it passes to someone else.

Freehold vs. Leasehold

A freehold owner controls the property and its value over time. A leaseholder controls the property only for the ground lease term. That difference shows up in financing and value: a leasehold mortgage gets harder to place as the remaining term shortens, and buildings on ground leases often trade at different cap rates than fee simple buildings.

Why It Matters in a Deal

The title insurance commitment and the deed show what interest is being conveyed. A buyer who assumes they're getting fee simple and later learns the land is ground-leased has a very different asset. Check early, during due diligence.

A Hypothetical Clearwater Example

Two similar retail buildings near Clearwater are for sale at the same price. In this example, one is a fee simple freehold; the other sits on a ground lease with 22 years left. The investor's lender will finance the freehold at a normal loan size but limits the leasehold loan because of the shorter remaining term. The freehold building is the better buy at the same price.
