Inverse Condemnation

Michael R. Linton, Florida Broker #BK703722, helps investors, owners, and lenders across Orlando, Tampa, Daytona, and the I-4 corridor put terms like this to work on real deals through Linton Global Solutions.

Inverse condemnation is a legal claim brought by a property owner arguing that a government action effectively took or damaged their property, even though the government never filed formal condemnation proceedings.

In ordinary eminent domain, the government starts the case and pays for what it takes. In inverse condemnation, the owner starts the case, arguing a taking already happened.

How It Differs from Eminent Domain

In eminent domain or condemnation, the government files suit to acquire property. Inverse condemnation reverses the roles: the owner sues, claiming that physical occupation, flooding, loss of access, or regulation went so far that it amounted to a taking.

The Florida Framework

The Florida Constitution requires full compensation when private property is taken for public use. Whether a particular action is a compensable taking is a fact-specific legal question; owners should work with an eminent domain attorney.

A Hypothetical Example

A road project permanently eliminates a small commercial property's only driveway. In this example, the owner's attorney evaluates whether the loss of access supports an inverse condemnation claim. Hypothetical scenario; not legal advice.

From the Desk

When a public project changes how your property works, get an attorney and an appraiser early. Valuation is the claim.
