Limited Warranty Deed

Michael R. Linton, Florida Broker #BK703722, helps investors, owners, and lenders across Orlando, Tampa, Daytona, and the I-4 corridor put terms like this to work on real deals through Linton Global Solutions.

A limited warranty deed, often called a special warranty deed, is a deed in which the seller warrants title only against defects arising while the seller owned the property, not against problems from earlier owners.

It sits between a general warranty deed and a quitclaim deed in the protection it gives the buyer.

Where It's Used

Special warranty deeds are common in commercial transactions and in sales by lenders, trustees, and REO sellers. Buyers typically rely on title insurance for protection against older defects. Florida conveyance law is in Chapter 689, Florida Statutes.

Compared With Other Deeds

A general warranty deed warrants against defects from any time; a quitclaim deed makes no warranty at all. The deed type is negotiated in the contract.

A Hypothetical Example

A bank selling an REO office building delivers a special warranty deed, and the buyer purchases an owner's title insurance policy. Hypothetical scenario; not legal advice.

From the Desk

Banks rarely give general warranty deeds on REO. Your real protection is the owner's title policy, so don't skip it.
