Tenancy by the Entirety

Michael R. Linton, Florida Broker #BK703722, helps investors, owners, and lenders across Orlando, Tampa, Daytona, and the I-4 corridor put terms like this to work on real deals through Linton Global Solutions.

Tenancy by the entirety is a form of co-ownership available only to married couples, in which each spouse owns the whole property, with a right of survivorship.

In Florida, it can protect property from creditors of only one spouse.

Florida

Florida recognizes tenancy by the entirety for real and personal property. Property held this way generally cannot be reached by creditors of just one spouse. Compare joint tenancy.

In Commercial Deals

Investment property is more often held in entities. Lenders may require both spouses to sign for entirety property.

A Hypothetical Example

A married couple owns a small Ocala office building as tenants by the entirety. When a creditor obtains a judgment against only one spouse, Florida law generally prevents that creditor from reaching the property. When they later sell, both spouses sign the deed. Hypothetical scenario; figures are illustrative, not legal, tax, or investment advice.
